Steve, could you walk us through one of the key steps involved in the estate planning process?
Absolutely. One crucial step is marshaling the estate assets. This involves meticulously identifying and inventorying all assets belonging to the deceased individual. Consequently, it’s essential to gather documents like bank statements, investment account summaries, property deeds, and vehicle titles.
Next, you need to determine the fair market value of each asset at the time of death. This valuation process often requires professional appraisals for real estate or complex assets. Once all assets are identified and valued, a formal inventory and appraisal document (typically Form DE-160/161 in California) needs to be filed with the probate court.
This step is critical because it provides a transparent accounting of the deceased’s assets, ensuring fairness for all heirs and beneficiaries. Moreover, accurate valuation helps prevent potential disputes down the line.
I imagine this process can sometimes be challenging?
You are right, it can present hurdles at times. For example, I once worked with a family where locating the deceased’s original will proved incredibly difficult. The will was last seen decades ago, and the family had no idea where it might be. Through diligent searching and communication with former associates of the deceased, we were finally able to locate the will hidden in an old safe deposit box. Notwithstanding this initial challenge, completing the inventory and valuation process allowed the estate to proceed smoothly and honor the testator’s wishes.
Another time, a client was unaware of a life insurance policy her husband had purchased years ago. Discovering this asset significantly impacted the distribution of the estate, allowing her to receive crucial financial support during a difficult period.
What advice would you give to individuals embarking on the estate planning process?
My advice is simple: start early and seek professional guidance. The earlier you begin planning for your future, the better prepared your loved ones will be. Ordinarily, working with an experienced probate attorney can ensure that all necessary steps are taken and potential pitfalls are avoided.
Remember, a well-crafted estate plan not only protects your assets but also provides peace of mind knowing that your wishes will be carried out.
