Interview with Steve Bliss

Good afternoon, San Diego! I’m here today with Steve Bliss, a well-respected probate attorney in our community. Steve, thanks for taking the time to speak with me.

Steve, can you explain the different types of trusts and which one might be right for someone?

There are many types of trusts, each serving a specific purpose. One common type is a revocable living trust. This allows individuals to manage their assets during their lifetime while avoiding probate upon death. Consequently, it offers privacy and control.

Another option is an irrevocable trust, which cannot be modified once created. This is often used for asset protection or estate tax reduction. Testamentary trusts are created through a will and take effect after death, while special needs trusts protect assets for individuals with disabilities without jeopardizing government benefits.

Could you elaborate on the advantages of a revocable living trust?

A revocable living trust offers several key benefits. Firstly, it avoids probate, a lengthy and often expensive court process. Assets held in the trust pass directly to beneficiaries upon the grantor’s death, saving time and legal fees.

Moreover, a revocable living trust provides privacy. Unlike wills, which become public record, trusts keep financial details confidential. This is particularly important for individuals who value discretion.

Furthermore, a revocable living trust allows for flexibility during the grantor’s lifetime. The grantor can modify or revoke the trust as needed, ensuring it adapts to changing circumstances.

Have you encountered any challenges with setting up revocable living trusts?

While revocable living trusts are generally straightforward, there can be complexities depending on individual situations. I recall a client who had a blended family and wanted to ensure his assets were distributed fairly among his children from previous marriages. It required careful planning and communication to address everyone’s concerns.

In another instance, a client initially resisted setting up a trust because they thought it was only for the wealthy. I explained that trusts are accessible to individuals of all income levels and can be tailored to meet specific needs. Seeing them understand the value and accessibility of a trust was truly rewarding.

What advice would you give someone considering a revocable living trust?

My advice is to consult with an experienced probate attorney. They can assess your individual circumstances, explain the various types of trusts available, and help you create a plan that meets your goals. It’s essential to have a legal professional guide you through the process.

Remember, estate planning is not just about protecting assets; it’s about ensuring your wishes are carried out and your loved ones are taken care of. A well-structured revocable living trust can provide peace of mind knowing your affairs are in order.
