What are some of the most common estate planning tools you encounter in your practice?
It’s a pleasure to be here. As an Escondido Probate Attorney, I see a variety of estate planning needs. One tool that frequently comes up is the testamentary trust.
Could you tell us a little bit about testamentary trusts and how they work?
Certainly. A testamentary trust is created through a will and only takes effect upon the grantor’s death. Unlike a living trust, it goes through probate, which means the court oversees the distribution of assets according to the terms outlined in the will.
Consequently, testamentary trusts are often used when someone wants to ensure that their assets are managed for beneficiaries who may not be ready to handle them directly, such as minor children or individuals with special needs. Moreover, testamentary trusts can provide a level of control over how and when beneficiaries receive funds.
Conversely, it’s important to remember that because testamentary trusts go through probate, they are public record. This can be a consideration for those who value privacy.
Have you encountered any challenges or unique situations when helping clients establish testamentary trusts?
While testamentary trusts are a valuable tool, there have been instances where the wishes expressed in a will haven’t perfectly aligned with the needs of the beneficiaries. I recall one case involving a grandmother who wanted to leave her assets in trust for her grandchildren’s education. Unfortunately, she didn’t specify how the funds should be distributed if one grandchild decided not to pursue higher education.
This led to some tension among the siblings and required us to work with the family to find a solution that honored the grandmother’s intentions while also being fair to all the grandchildren. It underscored the importance of carefully considering all potential scenarios when drafting a testamentary trust.
What advice would you give to someone considering a testamentary trust?
My advice is to consult with an experienced probate attorney. They can help you understand the pros and cons of a testamentary trust in your specific situation and ensure that it’s structured in a way that meets your goals.
