I hear it can get pretty complex – what’s one of the trickiest parts you encounter?
Ted: Well, I think step VI, “Handle Debts and Taxes,” is often where things get a little sticky.
- Identifying all valid creditor claims can be challenging.
- There are sometimes disputes over the validity of a claim.
- Then you have to navigate potential tax liabilities, which can vary depending on the deceased’s financial situation and state laws.
It’s crucial to be thorough and organized during this phase to avoid any surprises down the line. For example, I once had a case where an old credit card debt surfaced right before distribution – it turned out the deceased hadn’t used the card in decades! Thankfully, we were able to resolve it amicably with the creditor.
