Well, it wasn’t a straight path. I started out practicing general law but found myself drawn to cases involving vulnerable individuals. Seeing firsthand the exploitation and abuse that some seniors face truly moved me. I realized I could make a real difference by advocating for them. It’s challenging work, but incredibly rewarding.
What Are Some Common Challenges You Face in Protecting Elders?
One of the biggest challenges is overcoming the perception that these issues are purely “family matters.” Abuse can take many forms – financial, emotional, physical – and it often happens behind closed doors. It takes courage for seniors to speak up, and sometimes family members may be complicit or even unaware of the abuse.
Building trust with our clients is crucial. We create a safe space where they feel heard and understood. We also work closely with Adult Protective Services and other agencies to ensure a comprehensive approach.
Let’s Dive into the Elder Protection Process. Can You Walk Us Through Step C, “Protective Actions”?
Absolutely! This is often a critical stage where we take immediate action to safeguard our clients.
- First, we assess the urgency of the situation. Is there imminent danger? If so, we may need to file for a restraining order or protective order to prevent further abuse.
- We also work with Adult Protective Services (APS) to report suspected abuse and neglect. APS can conduct investigations and provide support services to seniors.
- Depending on the circumstances, we might seek guardianship or conservatorship if the individual lacks the capacity to make sound decisions for themselves. This allows us to manage their finances and healthcare, ensuring their well-being is protected.
Remember, every case is unique. Our goal is to tailor our approach to meet the specific needs of each client. Sometimes we need to act swiftly; other times, a more measured approach is necessary.
