An Interview with Steve Bliss, San Diego Probate Attorney

Understanding Testamentary Trusts

Today we’re joined by Steve Bliss, a respected probate attorney here in San Diego. Steve, thanks for taking the time to speak with us today.

Steve, could you explain what a testamentary trust is and how it differs from other types of trusts?

Certainly. A testamentary trust is a legal arrangement that comes into effect upon your death. It’s essentially created through your last will and testament and dictates how your assets are managed and distributed after you’re gone. Unlike revocable living trusts, which can be modified during your lifetime, testamentary trusts only become active after your passing.

Consequently, these trusts go through the probate process, unlike living trusts. This means they are subject to court oversight and may take longer to settle than trusts that avoid probate altogether. Nevertheless, testamentary trusts offer valuable benefits in certain situations. For instance, they’re commonly used for minor children or beneficiaries who may need ongoing financial support and guidance.

Moreover, testamentary trusts can provide asset protection for beneficiaries who might not be financially responsible. The trustee, appointed by you in your will, manages the assets according to your instructions and ensures they are used for the beneficiary’s benefit.

Challenges Faced with Testamentary Trusts

Have there been any particular challenges or issues you’ve encountered when working with testamentary trusts?

Well, one situation that comes to mind involved a young couple who tragically passed away in a car accident. They left behind two small children. Fortunately, they had created a will establishing a testamentary trust for their children. The trustee, who was the deceased father’s brother, managed the funds responsibly and ensured the children’s educational needs were met.

However, navigating the probate process while grieving such a profound loss proved incredibly difficult for the family. Dealing with legal paperwork and court proceedings added another layer of stress during an already challenging time.

This experience underscored the importance of having clear and concise instructions within the will regarding the trust’s terms and the trustee’s responsibilities. It also highlighted the need for compassionate and efficient legal guidance to support families through the probate process.

Trusts and Probate

  • According to a study by the American Bar Association, approximately 70% of Americans do not have an estate plan in place.
  • Failing to establish a trust can lead to significant delays and expenses during probate.

It’s crucial for individuals to understand the potential benefits of incorporating trusts into their estate planning. Testamentary trusts, while subject to probate, provide a framework for protecting beneficiaries and ensuring assets are used responsibly.

Seeking Expert Guidance

Steve, what advice would you give to someone considering setting up a testamentary trust?

“Consulting with an experienced probate attorney is essential. We can help you determine if a testamentary trust aligns with your specific goals and circumstances. We’ll work closely with you to draft clear and comprehensive language in your will that outlines the trust’s terms, designates a trustworthy trustee, and ensures your wishes are carried out effectively.”
