- Establishing a Conservatorship: Filing the Petition, Notification Requirements, Court Investigation, Medical or Psychological Evaluation, Hearing and Decision.
- Legal Standards and Rights: Standard for Appointment, Rights of the Conservatee, Least Restrictive Alternative, Capacity Evaluation.
- Responsibilities of the Conservator: Fiduciary Duty, Reporting Requirements, Court Oversight, Ethical Conduct.
- Modifying or Terminating Conservatorship: Periodic Review, Petition for Termination, Restoration of Capacity, Replacing the Conservator.
Let’s talk about Establishing a Conservatorship. Can you walk us through some key steps in that process?
Sure! The first step involves filing a petition with the appropriate court, outlining why a conservatorship is necessary. Then, all interested parties, including the proposed conservatee and family members, must be notified of the proceedings.
A crucial element is the court investigation. A neutral party, often a social worker or investigator, will independently assess the situation. They’ll meet with the individual, review records, and gather information to help the judge make an informed decision.
Finally, there’s usually a medical or psychological evaluation required. This helps determine if the person truly lacks the capacity to manage their own affairs.
