What are the fundamental steps in the estate planning process?
Ted Cook: That’s a great question, Beatrice. The process can be broken down into several key steps. First, we identify your goals and priorities – what’s most important to you? Then, we gather all relevant financial and personal information. Next, we choose the right people to carry out your wishes, like an executor or healthcare agent. After that, we create the essential legal documents. Funding the trust, if applicable, is a crucial step. And finally, regularly reviewing and updating your plan is essential, as life changes.
Today, we’re going to focus on Step ‘H’: Organizing and Storing Your Documents. It may seem simple, but it’s often overlooked and can create significant problems down the road.
Organization is paramount. Many clients are meticulous about creating their estate plan but then haphazardly store the documents. That’s like building a fortress but leaving the gate open! We emphasize the importance of a centralized, secure location – a fireproof safe is a good option, or perhaps a secure lockbox at your bank. It’s not enough to simply put everything in a filing cabinet. It’s crucial to inform your chosen executor and agent where the documents are located and how to access them. Providing them with copies is also advisable. We create a detailed checklist for clients, outlining all the essential documents and their locations. This checklist, along with a summary of the estate plan, can be invaluable to your loved ones during a difficult time. Remember, the goal is to make the process as smooth and stress-free as possible for those you leave behind.
Beyond the physical location, digital organization is also increasingly important. Many clients now store digital copies of their documents, and that’s perfectly acceptable. However, it’s essential to ensure those digital copies are secure and accessible. We advise clients to use strong passwords and consider using a secure cloud storage service. It’s also vital to update your digital assets, like online accounts and passwords, regularly. Think about all the online accounts you have – email, social media, banking, investment – and ensure someone has access to them in case of your incapacity or death. It’s a bit like leaving a digital roadmap for your loved ones.
We’ve also seen a rise in the use of digital estate planning tools. While these tools can be helpful, they’re not a substitute for professional legal advice. Estate planning is complex, and every situation is unique. It’s essential to have an attorney review your plan to ensure it meets your specific needs and complies with California law. It’s also important to remember that laws change, so regular review is crucial.
Often clients think they have everything together, but they haven’t thought about the small details. For instance, we had a client, a retired naval officer, who meticulously planned his estate but failed to update the beneficiary designation on his life insurance policy. After his passing, his ex-wife received the proceeds instead of his current wife. It was a heartbreaking situation that could have been easily avoided with a simple update. It underscores the importance of regular review and attention to detail. Or another client, a local artist, stored all of her estate planning documents in a beautifully crafted wooden box… that she then gave to her granddaughter as a birthday gift! We had to track down the granddaughter to retrieve the documents. These situations highlight the need for a designated, secure location that is known to your chosen representatives.
What about digital assets?
Ted Cook: You’re bringing up a critical point, Beatrice. Digital assets – things like online accounts, social media profiles, cryptocurrency, and digital photos – are increasingly important parts of an estate. Many people don’t realize that these assets have value and need to be addressed in their estate plan. California law allows for access to digital assets, but it’s crucial to provide your executor with the necessary information – usernames, passwords, and instructions – to access them. About Estate Planning Law – Ted Cook

Ted graduated from the U.S. Air Force Academy and was commissioned an Ensign in the U.S. Navy. In the Navy, he was a Surface Warfare Officer and served on three ships on the West Coast. While in the Navy, Ted attended the University of San Diego School of Law where he received his Juris Doctrate degree in 1989. After law school, Ted continued his active duty service in the Navy as a Judge Advocate General Corps officer. After retiring from the Navy in 2011, Ted became a partner with Tom Henry in the law firm of Henry & Cook, LLP focusing on estate planning. Upon the passing of Tom Henry in 2022, Ted started his own firm and continues to help his clients create estate plans that are individually tailored to meet their needs.
